PLATFORM ACCEPTABLE USE POLICY

This Platform Acceptable Use Policy (“AUP”) governs your use of the McCrossen Marketing Platform, including the website, customer portal, AI Advisor, document-generation and content tools, credits and tokens, connected third-party services, and McCrossen software plugins (collectively, the “Platform”). It is incorporated by reference into the McCrossen Marketing Terms of Service and any applicable service-specific terms. Your access may be suspended or terminated for violation of this AUP in accordance with those terms. Capitalized terms not defined here have the meaning given in the Terms of Service.
Reporting abuse. To report a violation of this AUP or a security concern, log in to your account and submit a support ticket. Copyright complaints are handled as described in the Copyrighted Material and DMCA section below.
1. General Conduct
You may not use the Platform to:
- Violate any applicable local, state, national, or international law or regulation;
- Submit false, misleading, or fraudulent information, register under a false name or with an invalid or unauthorized payment method, or initiate the transmission of any commercial electronic mail message with a deceptive or misleading subject heading that is likely to mislead a reasonable recipient about a material fact regarding the contents of the message;
- Impersonate any person or entity or misrepresent your affiliation;
- Attempt to gain unauthorized access to the Platform, other user accounts, or connected systems;
- Probe, scan, penetrate, or test the vulnerability of the Platform, or breach its security or authentication measures, without McCrossen’s express written consent;
- Interfere with or disrupt the Platform’s infrastructure, security features, or other users’ access, including through denial-of-service attacks, flooding, or resource exhaustion;
- Use automated tools (bots, scrapers, crawlers) to access the Platform except as expressly authorized, or use scripts or other automated means to register for multiple user accounts or to facilitate the transmission of commercial electronic mail;
- Circumvent or attempt to circumvent rate limiting, credit or token metering, usage quotas, security measures, or license validation.
2. AI-Powered Features
The Platform includes AI-powered features, such as the AI Advisor and document-generation and content tools, that are powered by third-party AI providers. When using these features, you may not:
- Submit prompts or inputs, or generate, store, or distribute outputs, that are illegal, harmful, threatening, abusive, harassing, defamatory, or that fall within the Offensive Content categories below;
- Use the AI features in any manner that violates the usage policies or terms of the third-party AI providers that power the Services;
- Attempt to extract, reverse engineer, or reconstruct McCrossen’s system prompts, scoring models, inference weightings, optimization logic, or other trade secrets, including through prompt injection or adversarial prompting;
- Use the Platform or its output to train, fine-tune, or develop any artificial-intelligence or machine-learning model;
- Attempt to cause the AI features to bypass their safety, security, or content controls;
- Represent AI-generated content as professional legal, financial, medical, or other licensed advice, or rely on it as such.
AI-generated content and recommendations are provided for informational and strategic purposes only, may not be unique to you, and you are solely responsible for reviewing, verifying, and editing such content before use, publication, or distribution.
3. Credits, Tokens, and Resale
You may not manipulate, exploit, or circumvent the credit or token system, generate output through unauthorized means, or resell or commercially redistribute Platform access or AI-generated output without McCrossen’s authorization. Credits and tokens are subject to the Terms of Service and the applicable Service Catalog terms.
4. Connected Third-Party Services
Where you connect third-party services (such as Google Analytics, Google Search Console, or Google Business Profile) to the Platform, you represent that you are authorized to grant access to the connected properties, and you must comply with the terms of those third-party services. You may not use connected-service access to collect or process data you are not authorized to access.
5. Offensive Content
You may not submit to, generate with, publish through, or store on the Platform any content, or links to any content, that McCrossen reasonably believes:
- Constitutes, depicts, fosters, promotes, or relates in any manner to child sexual abuse material, bestiality, or non-consensual sex acts;
- Is excessively violent, incites or threatens violence, or contains harassing content or hate speech;
- Is unfair or deceptive under the consumer-protection laws of any jurisdiction, including chain letters and pyramid schemes;
- Is defamatory or violates a person’s privacy;
- Creates a risk to a person’s safety or health, to public safety or health, compromises national security, or interferes with a law-enforcement investigation;
- Improperly exposes trade secrets or other confidential or proprietary information of another person;
- Infringes another person’s copyright, trademark, service mark, patent, or other proprietary right, or is intended to assist others in defeating technical copyright protections;
- Promotes illegal drugs, violates export-control laws, or relates to illegal gambling or illegal arms trafficking;
- Is used to generate spam, phishing content, or malicious advertising; or
- Is otherwise illegal, malicious, or fraudulent, or solicits conduct that is illegal under laws applicable to you or to McCrossen.
6. Regulated Data
You may not submit or store data subject to industry-specific legal or regulatory requirements — including firearms-transfer/FFL records, Protected Health Information (PHI) under HIPAA, or cardholder data under PCI-DSS — on the Platform except with the prior written consent of McCrossen and the execution of any additional agreements required by the Terms of Service or your service-specific terms, such as a Business Associate Agreement. You remain solely responsible for your compliance with all laws applicable to such data.
7. Copyrighted Material and DMCA
You may not use the Platform to copy, publish, distribute, or otherwise use any work protected by copyright unless you are authorized by the copyright owner or are otherwise permitted by law. It is McCrossen’s policy to terminate, in appropriate circumstances, the accounts of repeat infringers.
To submit a copyright-infringement notice under the DMCA, use the designated-agent contact form available through the McCrossen website so that complainants who do not hold a McCrossen account may submit notices. A valid notice must include the information required by 17 U.S.C. § 512(c)(3).
8. Enforcement and Modifications
McCrossen may investigate suspected violations and may remove, block, suspend, or disable access to content or accounts that violate, or that we reasonably believe violate, this AUP, with or without notice as the circumstances warrant. Our failure to enforce any provision is not a waiver. We may update this AUP from time to time; if we make material changes, we will notify you by email or through a prominent notice on the Platform. The current version is published on the McCrossen website, and your continued use of the Platform after such notice constitutes acceptance of the revised AUP.
